This payment is a method with which the court can ensure the attendance of the accused at any future court dates. The maximum penalty can reach a single year in jail as up to a $5,000 fine. Appearance of the defendant in court hearings is a must. The Court may also set certain pre-trial conditions in which certain criminal charges may qualify for a BAIL FORFEITURE. Agreeing to this means that the charge will appear on the defendant’s driving record as well as the assessment of a fine.

However the accused will then not have to appear for another court date. The case will proceed to sentencing if he\she pleads guilty. On the other hand, if the defendant pleads NOT guilty, then the case goes for a pre-trial conference which allows him/her to plan a defense or retain an attorney.

Arrest warrants will be issued by the court for failure of the defendant to appear at hearings or if he\she fails to follow the conditions of the court order. Cash bail or Bail bond posted for a defendant may be held until the case is completed. This will be exonerated by a judicial officer before the collateral is released by the bonding company or if the money is returned or refunded to the poster. The Court can issue a refund check to the individual who posted the cash bail if ordered by the judicial officer. This process will take 7-10 working days to process.
