The history behind the bail bonds have come a long way, starting back in the English period going into the colonial periods. In 1776, when the colonist declared independence they no longer felt a need for the English laws, but instead decided to form their own laws that were very similar to the English laws and traditions. Before 1776, the bail bonding process was a lot different then what went into place in 1776. It all started in England where they believe that the sheriff would decide whether the defendant would either stay in the jail and wait there until trail or if they could be released and guarantee that they would return for their trial. Back in these times, the sheriff held the responsibility to detain the defendant or release them. And some sheriffs in the medieval England times used the system for their own personal gain because they had the power to grant the defendant the right to be released or to detain them.
In today’s bail system, each defendant shall be permitted to be granted bail except in the case were the punishment is death. However, there are conditions on bail and getting a bail bondsman. These are basically very simple, as each bonds agency has their own set of rules and they can revoke the bond at any time if they feel like the defendant is not in compliance with their rules.
