You hear the term bail bond all the time, but what exactly does it mean? A bail bond was once known as a "surety bond". This is where a bail bond agent puts forth the bail money set by the court or jail where a certain defendant is being held; in return the defendant is released from jail on the bail bond. The bail bond is held as basically a guarantee that the defendant will appear at all scheduled court cases and hearings that they are required to attend by the judge. If they do not appear or miss any of the court cases for any reason at all then the bail bond is forfeited to the court as income, and the cosigner (usually a relative or close friend of the defendant) is then responsible to pay the full amount of the bail to the court as well. Plus, they lose out on any physical collateral that they were required to provide the bail bond agent with when they first started the bail bond process.
In some cases, a bounty hunter from the bail bond company will search for the defendant. Once they find the defendant, they have the legal right to arrest them and will do so. The cosigner is responsible for any costs that the bounty hunter incurred while searching for and arresting the defendant. In some cases, if an individual is arrested for skipping out on bail, then bail is either raised or the defendant is held in jail without a bail set.
