Since the 1800's Americas have been using private bail bonds to ensure that the defendants would show up and stand trial. Licensed bondsmen are responsible for the defendants that are bonded out on bail.
The bail bond process in the Harris county district is basically as follows: when a defendant is charged with a certain crime they have the opportunity go before a judge and the judge will determine if the defendant is eligible to be bonded out. In some cases they will be able to be bonded out in the courtroom, in others they will be refused bail, and then there are other cases were they will just be released on their own free will. It is rare to be refused from bail and it is usually only denied when an individual has jumped bail in the past. If they are able to bond out the bondman will assist with putting up the bond until the defendant goes to trial.
To be able to receive bail in the Harris County the defendant must put up between nine and twenty five percentage of what the bond is and the fee for the use of the bondman. There are several ways of putting up the nine to twenty five percent. Most bail bonds accept personal check, cash, credit card, or collateral. However when the defendant completes their legal obligation the bail is released back to the parties. If the defendant does not complete their legal obligation this is called “jumping bail”. In some cases, an example being the high figure of the set bail, the bail bondman will have a bounty hunter try and find the fugitive. If an individual has gone fugitive then any collateral put up for the ten percent of the bail will remain in the hands of the individual bail bondsman.
