A Quick Overview of the Bail Bond Process
For most people the concept of bail bonds is a bit perplexing. How can they afford to post bail? Will they post bail for anyone? What are the criteria for receiving a bail bond? If you are facing the possible or very real need to post bail for yourself or a loved one, you may need to become more acquainted with the process and gain a better understanding of the terms used by court officials.
What is “bail” and how is that different from a “bail bond”?
“Bail” is simply the money required by the court to be posted so that an individual may be released (temporarily) from custody. It is an individual’s guarantee that they will return for their court appearances. The family or friends of the individual who has been taken into custody may place money down with a bail bondsman, securing the “bail” in order to have the individual released from custody. This amount that is paid against the bail bond is usually 10% of the bail amount set by the courts.
A “bail bond” is the guarantee by an individual or company that they will appear in court (the “fact sheet”) in addition to the Power of Attorney that has been issued to the surety (bail bondsman). This document is filed with the Courts stating that the “bail” has been paid. Upon issuance of a bail bond the individual is released from the custody of the courts.
What exactly is a “bail bondsman” and how can they help me?
A bail bondsman is just a person that has a security agreement with the courts in a jurisdiction and has worked to secure a blanket bond (an agreement with an insurance company or a bank) that can be used to pay the court should an individual refuse to return to court. A bail bondsman is also responsible in many cases for finding an individual who “jumped bail”, either searching for the individual themselves or contracting someone to do it for them. A bail bondsman usually charges between ten and fifteen percent to place the bond, compensating themselves for both the blanket bond and the potential happenstance of an individual refusing to turn up in court.
Bail bondsmen are able to post bail at 1/10 the cost to you of what that bail is set at, so that the individual facing a $25K bail would be able to be released from custody by posting $2,500.
