The Case for Bail Bondsmen
“Bail” is defined and included in the criminal law of individual state constitutions, therefore the rules governing how one secures bail will vary from State to State. They strive to seek and defend, advertise and educate each area of the population on the benefits and importance of the existence of a lively and active commercial bail industry within Manhattan and the entire State of New York, even the entire United States of America.
There are many small independently licensed bail agents in the many counties of the State of New York. They operate mainly as a small family owned business. If it was not for the bail bonds, the professionally and independently licensed Manhattan bail bond agencies and their hard work with the city’s criminal justice system, Manhattan would be spending millions of dollars in housing for those in the criminal justice pipeline. This would punish taxpayers, strain local and federal resources in an effort to meet the dictates for humane punishment under the US Constitution. The fact that the word “bail bondsmen” is not usually synonymous with “compassion” or “charity” in the eyes of most is unfortunate, considering all that they provide, do, and the risks they take in order to provide an individual who has been charged with a crime the ability to walk free until his or her trial.
Bail bondsmen place a bail bond for complete strangers that is secured not by the defendant and their family, but by the bond agency’s insurance or bank. This is money that the defendant does not have, could not get, and will not ever have to pay thanks to the bail bondsman. There is more than money involved when a bail bond is issued—trust is involved. The bail bondsman places the bond for an individual that has been accused of a crime with the trust that he or she will show up in court at their appointed day and time.
A bail bond is basically a check that is post-dated. It symbolizes the person's promise/word that he or she will attend their court hearing when required to. The person purchasing the bail pond only pays about 10% of the amount of the bond.
The bail bond is paid by cash or check for the full amount of the bail that was posted. The other ways are as follows: property that is worth the full amount of the bail posted, a bond in which is a guaranteed payment of the full posted bail amount or a waiver of payment only on the condition that the defendant appears in court at the required time of their court hearing. This is also called by some "release on one's own recognizance"). If the defendant does not show up to their court date, the court keeps the bail money and issues a warrant for the defendant's arrest. At this time the bail bondsman is required to “find” the individual. All costs associated with this process are transferred to the defendant and their family.
In truth, bail bondsmen go out of their way to see that this does not happen. They establish guidelines, check up on the individuals, and in many cases counsel them. Ninety-eight percent of the defendants never have a severe problem or issue while out on bail provided by a bail bondsman.
