What is bail?
Bail is a monetary figure set by the courts based on preliminary findings in the arraignment. Bail is a type of insurance policy that an individual will appear in court for their trial and possible sentencing. If they do not, the court and the citizenry that it represents are awarded the bail amount. If they appear, the amount is returned to the individual who posted the cash bail or bail bond.
What is a bail bonds agency?
A bail bonds agency is an agency that is legally licensed and secured by a district to act as a power of attorney and post a blanket bond against a surety for an individual who has been placed into a court’s custody and given the opportunity for bail while awaiting trial. In a way they are an insurance policy for a defendant. It is their reputation, versus that of the defendant, which allows an individual to leave the custody of the jail.
I live in Pontiac, Michigan. Does Pontiac require you to use a bail bonds agency to post bail?
Absolutely not! You may post cash bail if you have the money. Pontiac bail bonds agencies exist to service those who do not have the amount set down by the court schedule.
How does the bail bonds process work?
A Pontiac bail bondsman requires that a defendant (or his or her family) post 10 to 15% of the bail amount in either cash or collateral and agrees to the stipulations of their agency. Once this amount has been handed over to the bail bondsman, the bail bondsman posts a bail bond with the jail (Power of Attorney plus fee). Once the jail receives the bond, the individual is released to the custody of the bail bondsman. Depending upon the stipulations, the individual may have to be released into a fixed dwelling of the bail bondsman’s approval and submit to daily check-ins. On the day that the individual returns the court, the bond collateral is returned.
What if an individual does not return to court?
The bail bondsman will call the individual in order to figure out if an emergency situation has occurred. If there was an emergency or an honest mistake occurred, the bail bondsman will work with the courts to right the situation rather than have the individual remanded into custody. If, however, the individual skips bail then the bond collateral reverts to the Pontiac bail bonds agency, a bounty hunter is hired and all associated costs with returning the individual to jail are now the onus of the defendant.
